Tuition Terms and Conditions
This Tuition Terms and Conditions Agreement ("Terms") is a legally binding contract between the student and/or their parent or legal guardian ("you") and Orange County Acting Academy ("OCAA," "we," "us," or "our"). By enrolling in any OCAA class, camp, workshop, or program ("Activities"), you acknowledge and agree to abide by these Terms in full, including related policies on payment, refunds, make-up classes, liability, and medical emergencies.
1. Enrollment and Agreement
Enrollment in OCAA programs constitutes acceptance of these Terms. This agreement supersedes all prior verbal or written understandings related to tuition, scheduling, cancellation, or participation.
2. Tuition Payment Terms
- Due Dates: Tuition is due on either the 1st or 15th of each month, depending on your selected billing schedule, or in full at enrollment unless a payment plan has been approved.
- Late Fees: A $15 late fee will be applied if payment is not received within five (5) calendar days of the due date.
- Returned Payments: A $15 fee applies to any returned or declined payments.
- Processing Fees: All credit/debit card transactions include a 3.5% + $0.30 processing fee.
- Financial Hardship: If you are experiencing financial difficulty, please contact ron@ocacting.com to discuss assistance options.
3. Pay-in-Full Policy
- Non-Refundable: All pay-in-full purchases are final and non-refundable unless one of the limited exceptions applies.
- Exceptions: Refunds may be considered in the case of:
- Documented Medical Emergency: Requires a doctor’s note.
- Unplanned Relocation: Must be outside a reasonable commuting distance and requires proof (lease, utility bill, etc.).
- Refund Process: Requests must be made in writing to ron@ocacting.com. If approved, refunds will:
- Be prorated based on unused classes remaining at the time of the request.
- Void all promotional discounts and recalculate tuition at the full rate of $260/month or $70/class.
- Be subject to a 10% administrative fee based on the full price of the package.
- No Guarantee: Approval of one refund does not obligate OCAA to issue similar refunds for other cases.
4. Termination and Withdrawal
- Month-to-Month Enrollments: Require a minimum of seven (7) days’ written notice before the final class. If not provided, the following month’s tuition will be charged in full.
- All Other Enrollments: Require 30 days’ written notice. The notice period begins at the end of the current billing cycle. Early termination may result in:
- A $50 cancellation fee
- Loss of promotional pricing and recalculation at full tuition rates
- OCAA-Initiated Termination: OCAA reserves the right to terminate enrollment for non-payment, misconduct, or policy violations. Refunds, if any, will follow the cancellation guidelines above.
5. Refunds and Credits
Refunds or credits will only be considered per Sections 3 and 4. No refunds apply to missed classes outside of the stated exceptions. All refunds deduct applicable administrative, cancellation, and processing fees.
6. Make-Up Class Policy
- Monthly Limit: Students may attend up to five (5) total classes per month, including make-ups.
- Scheduling Window: Missed classes must be made up within eight (8) weeks via the Parent Portal. After that time, the opportunity is forfeited.
- No Rollovers: Classes do not carry over or extend contract duration.
- Exceptions: If special circumstances arise, contact ron@ocacting.com for review.
7. Class Schedule and Modifications
OCAA reserves the right to change class schedules, instructors, or curriculum as needed. We will provide advance notice when possible.
8. Attendance and Conduct
- Attendance: Regular attendance is expected. Missing more than 20% of classes may result in removal without refund.
- Conduct: Respectful behavior is required. Any harassment, bullying, or disruption may result in immediate dismissal without refund.
9. Intellectual Property
All OCAA content (scripts, exercises, materials, video footage) is the intellectual property of OCAA and may not be copied, shared, or reproduced without prior written consent.
10. Photography and Recording
By enrolling, you consent to the use of your or your child’s image, voice, and likeness for promotional purposes, including photos and videos taken during classes and events. If you wish to opt out, you must submit a written request to ron@ocacting.com. OCAA will make reasonable efforts to honor opt-out requests going forward but cannot remove content captured prior to receipt.
11. Liability and Health
By participating, you accept the risks associated with physical activity and waive any claims against OCAA and its staff. If your child has a medical condition or injury, consult your physician before participation.
12. Equipment and Confidentiality
- Equipment: Students are responsible for any materials required for participation. A list will be provided as needed.
- Confidentiality: You agree to maintain the confidentiality of all proprietary techniques, materials, and student work shared in class.
13. Minors and Accessibility
- Parental Consent: Students under 18 must have signed consent from a parent or legal guardian.
- Accessibility: We strive to meet ADA standards. Contact info@ocacting.com to request accommodations.
14. Communication and Force Majeure
- Communication: We communicate through email, phone, or text. You are responsible for keeping your contact info current.
- Force Majeure: OCAA is not liable for any delays, class cancellations, or inability to perform obligations due to events beyond our control (e.g., natural disasters, pandemics, power outages, cyberattacks). Refunds or make-ups are not guaranteed in such cases.
15. Governing Law
These Terms are governed by the laws of the State of California. Any legal disputes shall be resolved in the courts of Orange County, California.
16. Changes to Terms
OCAA may update these Terms at any time. Changes become effective upon posting at ocacting.com/terms. It is your responsibility to review them periodically.
17. Media & Marketing Consent
You grant OCAA the right to use your image or your child’s image, voice, or likeness for promotional and educational purposes unless you submit a written opt-out request in advance. See our full Photo & Video Release Policy for details.
18. Acknowledgment and Agreement
By enrolling in OCAA, you acknowledge that you have read, understood, and agreed to all terms and policies set forth in this document, and that this agreement is binding upon you, your child, your heirs, executors, legal representatives, and assigns.
